La denuncia sobre la golpiza fue uno de los asuntos expuestos meses despu\u00e9s, en agosto de ese mismo a\u00f1o, ante el Congreso del Estado de Nayarit.<\/p>\n\n\n\n<p>Desde entonces, el afectado ha sostenido que el entonces alcalde ten\u00eda responsabilidad en garantizar su integridad mientras permanec\u00eda bajo custodia. No obstante, la Fiscal\u00eda General del Estado de Nayarit determin\u00f3 en su momento el no ejercicio de la acci\u00f3n penal, criterio que fue respaldado posteriormente por un juez de Control con sede en Bucer\u00edas.<\/p>\n\n\n\n<p>La situaci\u00f3n dio un giro en 2024, cuando un Juzgado de Distrito concedi\u00f3 un amparo a Valencia Castellanos, ordenando que el Ministerio P\u00fablico retomara la investigaci\u00f3n. Ahora, el Tribunal Colegiado resolvi\u00f3 que el recurso de inconformidad es procedente y que el juez de Control debe pronunciarse de manera expresa sobre si existe o no probable responsabilidad de G\u00f3mez P\u00e9rez en los hechos.<\/p>\n\n\n\n<p>Durante la semana en curso, el Juzgado Cuarto de Distrito en Nayarit, tras ser notificado de la resoluci\u00f3n del Tribunal Colegiado, indic\u00f3 que dar\u00e1 vista al juez de Control correspondiente para que cumpla con lo ordenado, lo que implica citar a audiencia y emitir una nueva resoluci\u00f3n respecto a la situaci\u00f3n jur\u00eddica
